What is an Auction Pack?

An Auction Pack is a bundle of legal documents which must be prepared and submitted to an Auction House before a Property can be sold at Auction. A good quality Auction Pack should contain the following documents:

1. Evidence of Ownership of the Property - Title Deeds & a Plan of the Property
2. Special Conditions of Sale - included as part of the Auction Contract of Sale
3. Property Information and Fixtures & Contents Forms
4. Local Authority Search Result
5. Drainage & Water Search Result
6. Energy Performance Certificate - (EPC)
7. Any Other Information, (such as copy Planning Permissions/Tenancy Agreement etc)

There are no set requirements for what should be included within the Auction Pack, but it is widely considered that the more information you are able to provide, the greater the chance of your Property being sold at Auction.

Most people who ask an Auction House to sell their Property will be advised that they should contact a solicitor in order to prepare the Auction Pack. However, there is no legal requirement for a solicitor to prepare the Auction Pack. This has just happened because solicitors are used to obtaining the required documentation as part of a normal sale transaction.

The drawback when using a solicitor to prepare the Auction Pack is that they are often busy dealing with the actual sale and purchase processes rather than understanding the need to prepare the Auction Pack as quickly and cost effectively as possible for you.

What will I need to do?

If you would like to order an Auctus Legal Auction Pack you will need to provide us with certain information and make payment by debit or credit card through our secure Ordering Page.

We will then send you an e-mail containing a Questionnaire and standard Property Information Forms for you to complete and return to us. We will also let you have some Help-sheets to assist you in completing the Forms properly. You can return the Forms to us by post or e-mail but the sooner you are able to do so the better as these will be included within your Auction Pack.

In the meantime we will obtain copies of the title deeds for your Property and order the Local Authority and Drainage & Water searches. We will also pass on your contact details to your local Energy Assessor who will contact you directly to arrange a time and date to visit your Property and carry out the inspection required to prepare the EPC.

The search results usually take between 5 - 10 days to be returned by our search provider and the EPC is usually ready within 7 days. It is therefore important that you return the completed Questionnaire and Property Information Forms, together with any accompanying documents as soon as possible so that the full Auction Pack can be completed and sent to the Auction House in plenty of time before the Auction.
